These Terms and Conditions govern every purchase made through the Site. Customers are asked to accept them actively at checkout.
This website at https://sicarchives.com (the "Site") is operated by Vika Dunamalyan, a sole trader resident in the Republic of Armenia, personal taxpayer identification number (TIN) 67140328, of Torosyan 4/3 Street, Apartment 12, Spitak, Lori Province, Republic of Armenia ("we", "us", "our", or the "Seller"). We trade under the name Vika Dunamalyan.
Our registered address for all legal notices, returns correspondence and service of documents is: Vika Dunamalyan, Torosyan 4/3 Street, Apartment 12, Spitak, Lori Province, Republic of Armenia.
You can contact us at support@sicarchives.com, by telephone on +374 98 241907, or by post at the address above. We aim to respond to customer enquiries within 2 to 5 business days.
We sell curated second-hand, vintage, archival and pre-owned fashion goods and related items ("Items") to consumers and, where expressly agreed, to business customers.
These Terms and Conditions of Sale (the "Terms"), together with our Privacy Policy, Cookie Policy, Returns, Withdrawal and Refund Policy, and Copyright and Intellectual Property Notice, form the entire agreement between you and us in relation to your purchase. Please read them carefully before placing an order.
By placing an order, you confirm that you have read, understood and accepted these Terms. If you do not accept them, you must not place an order.
We may amend these Terms from time to time. The version in force at the moment you place your order is the version that applies to that order. Amendments do not affect orders already accepted.
These Terms are available in English and in Armenian. In the event of any discrepancy between the two versions, the English version prevails, except where the law applicable to your purchase requires otherwise.
To place an order, you must be at least 18 years old and legally capable of entering into a binding contract. If you are under 18 you may use the Site only with the involvement and consent of a parent or legal guardian, who accepts responsibility for the order.
You confirm that any information you give us when ordering is accurate and complete, and that you are using a payment method you are authorised to use.
We may refuse, cancel or limit an order where reasonably necessary to prevent fraud, misuse or unlawful activity, subject to applicable consumer law.
Every Item we sell is second-hand. This is the defining characteristic of our business and it affects what you can reasonably expect. By ordering, you acknowledge and accept the following.
We describe each Item accurately and in good faith, including its condition, using our published condition grading. We photograph notable flaws. If you are unsure about any aspect of an Item, please contact us before ordering — we are happy to provide additional photographs or measurements.
We grade every Item before it is listed and publish the grade in the listing. Grading is our honest assessment of a second-hand Item and is necessarily a matter of judgement. It is made in good faith and is to be read together with the photographs and the written description, which always take precedence over the grade alone.
Where an Item has a flaw that affects its use or value, we describe it and photograph it regardless of the grade. If you are unsure how a grade applies to a particular Item, contact us before ordering.
Where an Item is described by reference to a brand, house or maker, we have assessed it in good faith on the basis of construction, materials, labelling, hardware, stitching and other indicators, and we believe the description to be accurate. Unless the listing expressly states that an Item is accompanied by a certificate of authenticity from an independent authentication service, we do not provide one.
We do not publish a representation of authenticity that we cannot reasonably support. Where the attribution of an Item is uncertain, the listing will say so rather than making an absolute authenticity guarantee.
We are an independent reseller. We are not an authorised dealer, agent, distributor or licensee of any brand whose goods we resell, and we are not affiliated with, sponsored by or endorsed by any such brand. Brand names and trade marks are used solely to identify and describe the goods offered for sale.
If you obtain, within 30 days of delivery, a written opinion from a recognised independent authentication service stating that an Item is not authentic, please contact us. Where we are satisfied that the opinion is credible, we will accept the return of the Item and refund the price paid in full, together with the original and return shipping costs. This remedy is in addition to, and does not limit, your statutory rights.
Our prices are set and charged in Euro (EUR). For convenience, prices may also be displayed in United States Dollar (USD) or Pound Sterling (GBP), at your selection. Amounts shown in those currencies are indicative conversions; the amount charged is the EUR amount, and your bank or card issuer may apply its own exchange rate and fees. The price in force at the time you place your order is the price that applies. Import duties and taxes and delivery charges are identified separately, as described in clauses 8 and 9.
Where the order confirmation we send you states an amount in EUR, that is the amount you will be asked to pay.
We take care to price accurately, but if we discover an obvious and unmistakable error in the price of an Item you have ordered, we will contact you before dispatch to ask whether you wish to proceed at the correct price or to cancel. We will not accept the order at the incorrect price without your agreement, and we will not rely on this clause to withdraw from a validly accepted order where the law does not permit it.
Shipping is charged at a flat rate of EUR 19 per order, to any destination, including addresses within the Republic of Armenia. The shipping charge is shown at checkout, as a separate line, before you place your order.
Shipping is free on orders where the value of the Items, before shipping and before import duties and taxes, is EUR 750 or more.
Import VAT, customs duties and related import charges are dealt with separately in clause 9.
Items are dispatched from the Republic of Armenia. An order delivered to an address outside Armenia may be subject to import duties, import VAT, customs clearance fees, brokerage fees or other charges levied by the authorities or carriers in the destination country.
The checkout tells you which of the following two positions applies to your order, before you confirm it.
Where a carrier or customs authority requires information or payment from you and you do not provide it, the Item may be delayed, returned to us or destroyed. Where an Item is returned to us in those circumstances, we will refund the price of the Item less the outbound and return shipping costs and any charges we incur, unless you are exercising a statutory right of withdrawal or cancellation. This applies whether or not duties were prepaid; where they were prepaid, we will also refund any import duties and taxes actually recovered by us.
You remain responsible for providing any information reasonably required by the carrier or customs authority, including where duties have been prepaid.
You are responsible for ensuring that the Item may lawfully be imported into your country. Some countries restrict the import of, among other things, goods containing fur, exotic leather, ivory, tortoiseshell, feathers or certain woods.
The display of an Item on the Site is an invitation to treat, not an offer. Your order is an offer to buy the Item on these Terms.
After you place your order we will send you an acknowledgement by email confirming that we have received it. This acknowledgement does not itself constitute acceptance of your order.
A binding contract comes into existence when we send you a dispatch confirmation email confirming that the Item has been sent, or when we otherwise expressly confirm acceptance, whichever occurs first. If we are unable to accept your order — for example because the Item has already sold, because we cannot verify your payment or delivery details, or because we cannot ship to your address — we will notify you and refund any payment taken in full, without undue delay.
Because our stock consists of single, unique Items, it is possible for the same Item to be ordered by more than one customer at the same time. Where this happens, we accept the first order received and cancel and refund the other.
Each Item carries a permanent reference, shown in the listing and repeated in your order confirmation, which identifies that individual Item.
We accept American Express, Visa, Mastercard, Google Pay and Apple Pay. Payment is taken either at checkout or, where the checkout says so, through a secure payment link that we send you by email after you place your order and before the Item is dispatched. We do not dispatch an Item until payment has been received in full.
Payment is processed by our payment provider. We do not receive or store your full card number, expiry date or security code. Your use of a payment service is subject to that provider's own terms and privacy notice.
If a payment is declined, reversed or charged back, we may cancel the order and, where the Item has been dispatched, recover the Item or the amount due.
We aim to dispatch Items within 2 to 7 business days of accepting your order. Available destinations, estimated delivery times and delivery charges are shown at checkout or in our shipping information. Estimated delivery times are estimates only; they are not guaranteed delivery dates.
Unless we agree otherwise, we will deliver within 30 days of the day the contract is formed. Where we fail to do so and delivery by a particular date was essential, or you have asked us to deliver within an additional period and we have not done so, you may cancel the order and receive a full refund.
Risk in the Item passes to you when the Item is delivered into your physical possession, or into the physical possession of a person you have identified to take delivery. Where you instruct us to use a carrier of your own choosing that we did not offer, risk passes when the Item is handed to that carrier. For qualifying consumer distance sales, the allocation of risk follows mandatory consumer law and we do not contract out of it.
Ownership of the Item passes to you when we have received payment in full and the Item has been delivered.
You must give us a complete and accurate delivery address. Where an Item is undeliverable, refused, or returned because of an incorrect or incomplete address or a failure to collect it, we will refund the price of the Item less our outbound and return shipping costs, unless you are exercising a statutory right of withdrawal.
If an Item arrives damaged, or does not arrive within 15 business days of the estimated delivery date, please tell us as soon as possible and in any event within 30 days of the estimated delivery date, so that we can investigate and, where appropriate, make a claim against the carrier. Where reasonably possible, please keep the packaging and send us photographs.
Our Returns, Withdrawal and Refund Policy forms part of these Terms and sets out in full: the statutory rights available to consumers in the Republic of Armenia; the right of withdrawal available to consumers in the European Union and European Economic Area; the equivalent right available to consumers in the United Kingdom; and your rights wherever you live where an Item is faulty, damaged in transit or materially different from its description.
Outside those cases, and because our Items are unique second-hand goods, we do not accept returns for change of mind. Nothing in these Terms or in that Policy limits or excludes any right you have under the mandatory consumer law applicable to your purchase, and we will not describe an Item as non-returnable merely because it is vintage.
We are under a legal duty to supply Items that conform to their description and to the contract.
An Item is not treated as failing to conform by reason of any characteristic, defect or sign of wear that was specifically described, disclosed or shown in the listing before you ordered, or that you were otherwise specifically informed of before you ordered, and which you accepted by placing the order. This reflects the nature of second-hand goods and is expressly drawn to your attention here.
Where an Item does not conform to the contract, you are entitled to the remedies available under the law applicable to your purchase, which may include repair, replacement, a proportionate price reduction or termination of the contract with a refund. Because our Items are unique, replacement is generally not possible, and we will normally offer a price reduction or a refund on return of the Item.
We take reasonable care to offer Items that are safe for their intended use. Vintage goods were made to the standards of their time and may not meet current safety standards. Where an Item requires repair, cleaning or refurbishment before use, we say so in the listing.
We do not sell electrical or electronic Items, appliances, or goods requiring mains or battery power. Where any accessory or component of an Item incidentally contains a battery or electrical part not intended for continued use, this will be stated in the listing.
We do not sell vintage children's items, nightwear, cots, car seats or similar goods.
Fibre composition. Textile Items are subject to the fibre composition labelling requirements of Regulation (EU) No 1007/2011 where they are made available on the EU market. That Regulation contains no general exemption for second-hand goods. Where an Item carries its original composition label, or where the composition is otherwise established from the maker's specification or from testing, we publish that composition in the listing. Where the original label is missing, illegible or has been removed, and the composition cannot be established, the listing says so expressly rather than stating a composition we cannot support. We do not estimate fibre content by feel or appearance.
Product identification. Each Item carries a permanent reference, shown in the listing, on the order confirmation and with the Item itself, which identifies that individual Item.
Current position. No Responsible Person established in the European Union has yet been appointed in relation to the Items. This clause records the obligation and the steps being taken; it does not represent that the obligation is currently satisfied.
Regulation (EU) 2023/988 (the "GPSR") applies to second-hand products as well as to new ones: Article 2(3) states expressly that it applies to products that are new, used, repaired or reconditioned. The only relevant carve-out is the exclusion for antiques in the final point of Article 2(2). "Antique" is conventionally understood by reference to Annex IX of Directive 2006/112/EC, which sets a threshold of more than one hundred years. Almost nothing we sell meets that threshold, and we do not rely on that exclusion.
Article 16(2) GPSR provides that a product may not be placed on the EU market unless there is an economic operator established in the Union who is responsible for the tasks set out in Article 4(3) of Regulation (EU) 2019/1020 (the "Responsible Person").
Where a Responsible Person is appointed, the Seller will ensure that the name, registered trade name or trade mark, and contact details of the Responsible Person, including a postal address and an electronic address, are given in two places:
These are cumulative obligations. Satisfying one does not satisfy the other. Because the Seller holds its own stock and fulfils every order directly, the Seller is responsible for ensuring that the Responsible Person's details accompany each Item at the point of shipment as well as appearing in the listing.
Manufacturer details. Article 19 GPSR also requires the online offer to state the manufacturer's name, registered trade name or trade mark, and postal and electronic address. For most of our Items, which are vintage or second-hand clothing and accessories, the original manufacturer may no longer exist, may not be identifiable, or may not be contactable. Where that is the case, the listing states clearly, before purchase, that the Item is vintage or second-hand and not new, that the original manufacturer may no longer exist or be contactable, and that manufacturer warranties applicable to new products do not apply. Where the manufacturer is known but is not reachable despite reasonable enquiry, we record those enquiries in our internal compliance file. None of this is a substitute for appointing a Responsible Person, who remains the designated contact for consumers and authorities on product safety and compliance.
You may use the Site only for lawful purposes. You must not:
We may suspend or terminate your access to the Site, refuse or cancel orders, and take legal action where we reasonably believe this clause has been breached.
Where the Site allows you to submit reviews, images, comments or other material ("Customer Content"), you must ensure it is accurate, lawful, and your own or lawfully licensed to you. You must not submit a review for an Item you have not purchased from us.
By submitting Customer Content, you grant us a non-exclusive, royalty-free, worldwide, sub-licensable licence to use, reproduce, adapt, publish and display it in connection with the Site and our marketing, for as long as the Content remains published. You may ask us to remove your Customer Content at any time.
We may remove or decline to publish Customer Content that breaches these Terms, but we are not obliged to monitor it.
We make the Site available free of charge but do not guarantee that it will be uninterrupted, error-free or free of viruses. We may suspend, withdraw or restrict all or part of the Site for maintenance, security, or other business or operational reasons, and will give notice where reasonably practicable.
You are responsible for the arrangements and equipment necessary to access the Site, and for ensuring that all persons accessing it through your connection are aware of these Terms.
The Site uses third-party payment, delivery, analytics, hosting, social-media and similar services, and may link to third-party websites. Those services and websites have their own terms and privacy notices, and we are not responsible for their content or availability.
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot lawfully be excluded or limited under the law applicable to your purchase; or your statutory rights as a consumer.
Subject to the paragraph above, and where you are a consumer:
Subject to the first paragraph of this clause, our total liability to you in connection with any order is limited to the total amount you paid for that order.
Where you are a business customer, the Site and the Items are supplied without any warranty, condition or other term implied by statute or common law to the fullest extent permitted by law, and our total liability in contract, tort (including negligence), breach of statutory duty or otherwise is limited to the price paid for the Item concerned.
We are not liable for any failure or delay in performing our obligations caused by an event outside our reasonable control, including strikes, carrier failures, civil unrest, armed conflict, border or airspace closures, natural disasters, epidemics, failures of telecommunications or utilities networks, customs procedures and acts of government. Where such an event occurs we will contact you as soon as reasonably possible, and where the delay is substantial you may cancel the affected order and receive a full refund.
If you are unhappy with an Item or with our service, please contact us first at support@sicarchives.com. We aim to acknowledge complaints within 2 to 5 business days and to resolve them within 14 days. Most matters are resolved at this stage.
Any mandatory consumer complaint, mediation, administrative or judicial rights available to you under applicable law remain unaffected. Consumers in the European Union may obtain free assistance with a cross-border dispute from the European Consumer Centres Network (ECC-Net) in their country of residence.
These Terms and any contract formed under them are governed by the law of the Republic of Armenia. Disputes are subject to the exclusive jurisdiction of the courts of the Republic of Armenia.
If you are a consumer habitually resident in the European Union or European Economic Area, this choice of law does not deprive you of the protection afforded to you by provisions of the law of your country of residence that cannot be derogated from by agreement, and you may bring proceedings in the courts of your country of residence. The same applies to consumers resident in the United Kingdom and in any other jurisdiction whose law confers equivalent non-excludable protection.
Severability. If any provision of these Terms is held to be unlawful or unenforceable, the remaining provisions continue in force.
No waiver. Our failure or delay in enforcing any provision is not a waiver of it.
Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to another organisation, and will tell you in writing if we do; this will not affect your rights.
Third parties. No person other than you and us has any right to enforce these Terms.
Entire agreement. These Terms, together with the documents referred to in them, constitute the entire agreement between you and us and supersede any prior statement, save that nothing limits our liability for fraudulent misrepresentation.
